Scapegoats
Can the government really get away with scapegoating these privates for carrying out policies handed down from Bush, Cheney, and Rumsfeld? If they charged every private who engaged in torture of prisoners there'd be no one left to fight the war.
When will charges be levied against Bush? Against Rumsfeld? When will we de-Bush-ify the U.S. military?
